Human Service Agencies Essay
Human service agencies are formed by and for the public. As communities grow and change, the need to respond to the demands of these dynamic societies also increases. Not only does the society lay itself open to positive opportunities, it is also exposed to the negative drawbacks of this dynamism. In fact, there are so many social issues that individuals alone cannot resolve. These are matters concerning the society that need sufficient and appropriate attention also from the society. These agencies do serve as intermediaries between solutions to problems and individuals, families, and societies. There are many issues that individuals, families and societies have that need communal action. I believe that these important issues include the most rampant problems nowadays encountered by people. Even the simplest problems like underage alcoholism, drug dependence, compulsive gambling, widespread crimesâ⬠¦ these are social issues that need immediate attention. Issues starting in individuals or within families also necessitate consideration. Some of these are problems of child and women abuse, violence within and outside families, severe and persistent illnesses, including contagious ones, severe emotional disturbances experienced by people, and the like. I think, these ââ¬Ësimpleââ¬â¢ matters must be acted upon immediately by service organizations like human service agencies. This is to mediate and assure proper assistance to individuals and families, thereby assuring their safety, peacefulness, health and wellness, and the societyââ¬â¢s as well. I also believe that there are no least important issues, as long as individuals or families, or members of the society are involved, they are considered issues that must be resolvedâ⬠¦ immediately. I arrived at this standpoint because I myself am a member of this society. Directly or indirectly, I rely and I may rely in the future in these human service agencies for betterment, improvement, protection and the like. And I must not be concerned only about myself but also about the welfare of the whole society.

Every state has adopted Article 3 of the Uniform Commercial Code (UCC), with some modifications, as the law governing negotiable instruments. The UCC defines a negotiable instrument as an unconditioned writing that promises or orders the payment of a fixed amount of money. Drafts and notes are the two categories of instruments.A draft is an instrument that orders a payment to be made. An example is a check. A note is an instrument that promises that a payment will be made. Certificates of deposit (CD's) are notes. Drafts and notes are commonly used in business transactions to finance the movement of goods and to secure and distribute loans. To be considered negotiable an instrument must meet the requirements stated in Article 3. Negotiable instruments do not include money, payment orders governed by article 4A (fund transfers) or to securities governed by Article 8 (investment securities).The rule of derivative title, which is applicable in most area s of the law, does not allow a property owner to transfer rights in a piece of property greater than his own. If an instrument is negotiable this rule is suspended. A good faith purchaser, who does not have any knowledge of a defect in the title or claims against it, takes title to the instrument free of any defects or claims. In relation to the suspension of the rule of derivative title, Article 3 provides for warranties to protect the parties in transactions involving negotiable instruments.Checks are negotiable instruments but are mainly covered by Article 4 of the UCC. Secured transactions may contain negotiable instruments but are predominantly covered by Article 9 of the UCC. If there is a conflict between the Articles of the UCC both Article 4 and 9 govern over Article 3. 1 First chapter: Introduction 2 1. 1. Statement of The Study The word negotiable means ââ¬Ëtransferable by deliveryââ¬â¢ and the word ââ¬Ëinstrumentsââ¬â¢ means a written document by which a righ t is created in favor of a person. Thus, the term negotiable instruments literally refer to a document containing rights that can be transferred by elivery. According to Section 13 (a) of the Act, ââ¬Å"Negotiable instrument means a promissory note, bill of exchange or cheque payable either to order or to bearer, whether the word ââ¬Ëorderââ¬â¢ or ââ¬Ëbearerââ¬â¢ appear on the instrument or not. â⬠The rights that could be incorporated in negotiable instruments may be rights for payment of money arising out of various contracts such as the contract of loan, sale, lease, or any other contract performed by payment of a certain amount of money. Such rights may also arise from ownership in companies or loan made to the government or to a share company.The rights that are incorporated in negotiable instruments may be rights to receive goods under voyage or deposited in a warehouse. According to this provision, the holder of negotiable instruments can transfer the rights incorporated in the instrument by transferring the instrument. Similarly, a person who claims the rights incorporated in negotiable instruments may enforce or exercise them only if he has possession of the instrument, i. e. , he should be a holder to whom the instrument is issued or transferred following the rules governing its transfer.He must also present the instrument to the person who is supposed to perform the obligations arising out of the instrument. The fact that the rights incorporated in negotiable instruments may be transferred by the transfer of the instrument and the fact that a person may not exercise or enforce them unless he is in possession of the instrument are the two main features which distinguish negotiable instruments from other documents evidencing rights such as a title deeds whose transfer does not transfer the rights they establish.Another point that has to be noted here is that negotiable instruments are issued or negotiated based on other contracts. Fo r instance, a person may issue a bill of exchange to repay the money he has borrowed from the payee, the company issues a share certificate or debenture certificate as evidence of the personââ¬Ës right arising out of contract of partnership creating the company or a contract of loan respectively. The warehouse person or the carrier issues the warehouse goods deposit certificate or the bill of lading / consignment note based on contracts of warehousing or carriage respectively.Finally, the definition of negotiable instruments under the Ethiopian law is much wider than the one adopted by most legal systems, particularly those following the Common Law tradition. This is evident from the Uniform Commercial Code of the United States and the Bill of Exchanges Act of 1882, which restricts the concept to bills of exchange, cheques and promissory notes. 3 1. 2. Objectives of the Study Objective means the main reason or the main goals of the study. Here after this study we should be able t o- ? Understand meaning, essential characteristics and types of negotiable instruments; ?Describe the meaning and marketing of cheques, crossing of cheques and cancellation of crossing of a cheque; ? Explain capacity and liability parties to a negotiable instruments; and ? Understand various provisions of negotiable instrument Act, 1881 regarding negotiation, assignment, endorsement, acceptance, etc. of negotiable instruments. 4 Second chapter: General Context of the Study 5 2. 1. Literature Review The term, negotiable instrument means a written document which creates a right in favor of some person and which is freely transferable.Although the Act mentions only these three instruments (such as a promissory note, a bill of exchange and cheque), it does not exclude the possibility of adding any other instrument which satisfies the following two conditions of negotiability: a) the instrument should be freely transferable (by delivery or by endorsement. and delivery) by the custom of t he trade; and b) the person who obtains it in good faith and for value should get it free from all defects, and be entitled to recover the money of the instrument in his own name.A negotiable instrument is a document which includes a promise to pay a set sum of money to the bearer of the document either on demand or on a given date. The instrument can be freely transferred without the need to notify the person from whom it originated. Negotiable instruments are used to enable trade, because without them, people would be obliged to exchange money in person for all sorts of transactions, and this would quickly become unsafe in addition to unwieldy.One simple example of a negotiable instrument is a check. A check is written out to the bearer for a specific amount. The bearer can take the check to a bank and deposit it, thereby transferring the obligation to the bank. The bearer can also sign the check over to someone else, another example of a transfer. Checks also demonstrate another important property of negotiable instruments, which is that people need to have them in hand to redeem or negotiate them. If the document is lost, it cannot be called upon.As such, documents like share warrants payable to bearer, debentures payable to bearer and dividend warrants are negotiable instruments. But the money orders and postal orders, deposit receipts, share certificates, bill of lading, dock warrant, etc. are not negotiable instruments. Although they are transferable by delivery and endorsements, yet they are not able to give better title to the bona fide transferee for value than what the transferor has. 6 2. 2. Characteristics of a Negotiable Instrument A negotiable instrument has the following characteristics: ? Property:The possessor of the negotiable instrument is presumed to be the owner of the property contained therein. A negotiable instrument does not merely give possession of the instrument but right to property also. The property in a negotiable instrument ca n be transferred without any formality. In the case of bearer instrument, the property passes by mere delivery to the transferee. In the case of an order instrument, endorsement and delivery are required for the transfer of property. ? Title: The transferee of a negotiable instrument is known as ââ¬Ëholder in due course. A bona fide transferee for value is not affected by any defect of title on the part of the transferor or of any of the previous holders of the instrument. ? Rights: The transferee of the negotiable instrument can sue in his own name, in case of dishonor. A negotiable instrument can be transferred any number of times till it is at maturity. The holder of the instrument need not give notice of transfer to the party liable on the instrument to pay. ? Presumptions: Certain presumptions apply to all negotiable instruments e. g. , a presumption that consideration has been paid under it.It is not necessary to write in a promissory note the words ââ¬Ëfor value receive dââ¬â¢ or similar expressions because the payment of consideration is presumed. The words are usually included to create additional evidence of consideration. ? Prompt Payment: A negotiable instrument enables the holder to expect prompt payment because a dishonor means the ruin of the credit of all persons who are parties to the instrument. 7 2. 3. The Nature and Purpose of Negotiable Instruments Negotiable instruments represent one form of property rights, i. e. exercised over incorporeal things ââ¬Å"chose in action. â⬠In other words, they are property rights in relation to objects of property which do not have physical or material existence and hence which cannot be perceived by the senses. A right of action under contract is a class of property known as ââ¬Ëchose in actionââ¬â¢ and can be distinguished from a corporeal movable property/ a ââ¬Ëchose in possessionââ¬â¢ which represent property rights exercised in relation to objects which have material or phy sical existence and hence can be perceived by the senses such as a book, a table or a watch.A holder of this type of property right must have actual possession of the object to exercise rights arising there from. Rights incorporated in negotiable instruments, rights of an inventor arising out of a grant of a patent in respect of his invention, rights of a copyrights holder, and rights of a trader in respect of his trademark, trade name and goodwill are instances of chose in action. Negotiable instruments also represent one kind of contract as every instrument embodies a contract or promise to pay a certain amount of money or to deliver goods according to terms agreed up on.As contracts, the general rules of contract shall apply unless they are specifically excluded from application by the special law applicable to negotiable instruments. As a result, the requirements necessary for the formation of a valid contract must be fulfilled for issuance of a valid and enforceable negotiable instrument. Hence, the parties who sign a negotiable instrument must have capacity under the law to enter into juridical acts, i. e. , minors and judicially interdicted persons may not create a valid contract through negotiable instruments.Furthermore, as a contract, any declaration or promise made on negotiable instruments must be accompanied by the signature of the person bound by such declaration or promise. Failure to comply with the requirements as to capacity and signature may be raised as a defense against any person who claims based on the instrument even against the holder in due course who, under other cases, is considered to be free from defenses available against the person who transferred the instrument to him. The parties must give their consent, which must be free from defects such as mistake, fraud, duress.The object of the contract must also be legal and possible. Where the contract does not fulfill requirements as to consent and object, a party affected may raise i t as a defense to avoid the contract and liability under the instrument. However, because of the special nature of these instruments, such defenses cannot be raised against a person, who acquires the instrument following the rules of transfer applicable to the instrument, and in good faith. 8 The main purpose of negotiable instruments is facilitation of commercial transactions.Commercial instruments are substitutes for money and are used as means of performance of money obligations. Dealing with them reduces the risk of loss or theft and the ease with which they can be transferred creates convenience which will in turn facilitate business. Transferable securities have the purpose of raising capital in the form of contributions made by purchase of shares and bonds, which is used for starting new businesses or expansion of existing businesses thereby increasing the production of goods and services in the country.A document of title to goods, whose negotiation transfers the goods repre sented by them, creates convenience and facilitates transactions involving the goods. For instance, a person selling warehoused goods can do so by endorsing and transferring the certificate of deposit and without the need to actually deliver the objects. When we come to the specific purposes of commercial instruments, promissory notes can be used as means of borrowing money, buying goods and services on credit and as method of evidencing a pre-existing debt.Certificates of deposit can be used as a device for encouraging individuals to deposit funds in banks; in return the holder of the certificate has the right to receive interest. Bills of exchange on the other hand have the purpose of collecting accounts financing, the movement of goods, and transfer funds. Checks serve as ââ¬Å"vehicles for transfer of money and also used to aid in keeping records, reduces the risk of loss and destruction and theft of currencies. â⬠9 2. 4.Types of Negotiable Instrument Section 13 of the Ne gotiable Instruments Act states that a negotiable instrument is a promissory note, bill of exchange or a cheque payable either to order or to bearer. Negotiable instruments recognized by statute are: (i) Promissory notes (ii) Bills of exchange (iii) Cheques. Negotiable instruments recognized by usage or custom are: (i) Hundis (ii) Share warrants (iii) Dividend warrants (iv) Bankers draft (v) Circular notes (vi) Bearer debentures (vii) Debentures of Bombay Port Trust (viii) Railway receipts (ix) Delivery orders. 2. 4. 1.Promissory Notes Section 4 of the Act defines, ââ¬Å"A promissory note is an instrument in writing (note being a bank-note or a currency note) containing an unconditional undertaking, signed by the maker, to pay a certain sum of money to or to the order of a certain person, or to the bearer of the instruments. â⬠Essential elements: 1. It must be in writing 2. It must certainly an express promise or clear understanding to pay 3. Promise to pay must be unconditio nal 4. It should be signed by the maker 5. The maker must be certain 6. The payee must be certain 7. The promise should be to pay money and money only 8.The amount should be certain; and 9. Other formalities regarding number, place, date, consideration etc. 10 2. 4. 2. Bill of Exchange Section 5 of the Act defines, ââ¬Å"A bill of exchange is an instrument in writing containing an unconditional order, signed by the maker, directing a certain person to pay a certain sum of money only to, or to the order of a certain person or to the bearer of the instrumentâ⬠. A bill of exchange, therefore, is a written acknowledgement of the debt, written by the creditor and accepted by the debtor. There are usually three parties to a bill of exchange drawer, acceptor or drawer and payee.Drawer himself may be the payee. Essential conditions of a bill of exchange: 1. It must be in writing. 2. It must be signed by the drawer. 3. The drawer, drawee and payee must be certain. 4. The sum payable mu st also be certain. 5. It should be properly stamped. 6. It must contain an express order to pay money and money alone. 7. The order must be unconditional. Bills can be classified as: ? Inland and foreign bills. ? Time and demand bills. ? Trade and accommodation bills. 2. 4. 3. Cheques Section 6 of the Act defines ââ¬Å"A cheque is a bill of exchange drawn on a specified banker, and not expressed to be payable otherwise than on demandâ⬠.A cheque is bill of exchange with two more qualifications, namely, (i) it is always drawn on a specified banker, and (ii) it is always payable on demand. Consequently, all cheques are bill of exchange, but all bills are not cheque. A cheque must satisfy all the requirements of a bill of exchange; that is, it must be signed by the drawer, and must contain an unconditional order on a specified banker to pay a certain sum of money to or to the order of a certain person or to the bearer of the cheque. A bill of exchange is usually drawn on some person or firm, while a cheque is always drawn on a bank. 2. It is essential that a bill of exchange must be accepted before its payment can be claimed a cheque does not require any such acceptance. . A cheque can only be drawn payable on demand, a bill may be also drawn payable on demand, or on the expiry of a certain period after date or sight. 4. A grace of three days is allowed in the case of time bills while no grace is given in the case of a cheque. 5. The drawer of the bill is discharged from his liability, if it is not presented for payment, but the drawer of a cheque is discharged only if he suffers any damage by delay in presenting the cheque for payment. 6. Notice of dishonor of a bill is necessary, but no such notice is necessary in the case of cheque. . A cheque may be crossed, but not needed in the case of bill. 8. A bill of exchange must be properly stamped, while a cheque does not require any stamp. 9. A cheque drawn to bearer payable on demand shall be valid but a bill payable on demand can never be drawn to bearer. 10. Unlike cheques, the payment of a bill cannot be countermanded by the drawer. 12 2. 4. 4. Hundis A ââ¬Å"Hundiâ⬠is a negotiable instrument written in an oriental language. The term hundi includes all indigenous negotiable instruments whether they be in the form of notes or bills.The word ââ¬Ëhundiââ¬â¢ is said to be derived from the Sanskrit word ââ¬Ëhundiââ¬â¢, which means ââ¬Å"to collectâ⬠. They are quite popular among the Indian merchants from very old days. They are used to finance trade and commerce and provide a fascicle and sound medium of currency and credit. Hundis are governed by the custom and usage of the locality in which they are intended to be used and not by the provision of the Negotiable Instruments Act. In case there is no customary rule known as to a certain point, the court may apply the provisions of the Negotiable Instruments Act.It is also open to the parties to expressly exclude the applicability of any custom relating to hundis by agreement (lndur Chandra vs. Lachhmi Bibi, 7 B. Functions of Negotiable Instruments Negotiable instruments serve the following functions: ? Substitute for money ? Credit device ? Record-keeping device Most purchases by businesses and many individuals are made by negotiable instruments instead of cash. 2. 7. Endorsement The word ââ¬Ëendorsementââ¬â¢ in its literal sense means, writing on the back of an instrument. But under the Negotiable Instruments Act it means, the writing of oneââ¬â¢s name on the back of the instrument or any paper attached to it with the intention of transferring the rights therein.Thus, endorsement is signing a negotiable instrument for the purpose of negotiation. The person who effects an endorsement is called an ââ¬Ëendorserââ¬â¢, and the person to whom negotiable instrument is transferred by endorsement is called the ââ¬Ëendorseeââ¬â¢. Essentials of a valid endorsement: The following are the essentials of a valid endorsement: 1. It must be on the instrument. The endorsement may be on the back or face of the instrument and if no space is left on the instrument, it may be made on a separate paper attached to it called allonage. It should usually be in ink. 2.It must be made by the maker or holder of the instrument. A stranger cannot endorse it. 3. It must be signed by the endorser. Full name is not essential. 4. It may be made either by the endorser merely signing his name on the instrument (it is a blank endorsement) or by any words showing an intention to endorse or transfer the instrument to a specified person (it is an endorsement in full). 5. It must be completed by delivery of the instrument. The delivery must be made by the en dorser himself or by somebody on his behalf with the intention of passing property therein. 6.It must be an endorsement of the entire bill. A partial endorsement i. e. which purports to transfer to the endorse a part only of the amount payable does not operate as a valid endorsement. If delivery is conditional, endorsement is not complete until the condition is fulfilled. 14 The payee of an instrument is the rightful person to make the first endorsement. Thereafter the instrument may be endorsed by any person who has become the holder of the instrument. The maker or the drawer cannot endorse the instrument but if any of them has become the holder thereof he may endorse the instrument (Sec. 51).The maker or drawer cannot endorse or negotiate an instrument unless he is in lawful possession of instrument or is the holder there of. A payee or indorsee cannot endorse or negotiate unless he is the holder there of. 2. 8. Dishonor of a Negotiable Instrument When a negotiable instrument is d ishonored, the holder must give a notice of dishonor to all the previous parties in order to make them liable. A negotiable instrument can be dishonored either by non-acceptance or by non-payment. A cheque and a promissory note can only be dishonored by non-payment but a bill of exchange can be dishonored either by nonacceptance or by non-payment. . 8. 1. Dishonor by non-acceptance (Section 91) A bill of exchange can be dishonored by non-acceptance in the following ways: 1. If a bill is presented to the drawee for acceptance and he does not accept it within 48 hours from the time of presentment for acceptance. When there are several drawees even if one of them makes a default in acceptance, the bill is deemed to be dishonored unless these several drawees are partners. 2. When the drawee is a fictitious person or if he cannot be traced after reasonable search. 3.When the drawee is incompetent to contract, the bill is treated as dishonored. 4. When a bill is accepted with a qualified acceptance, the holder may treat the bill of exchange having been dishonored. 5. When the drawee has either become insolvent or is dead. 6. When presentment for acceptance is excused and the bill is not accepted. 15 2. 8. 2. Dishonor by non-payment (Section 92) A bill after being accepted has got to be presented for payment on the date of its maturity. If the acceptor fails to make payment when it is due, the bill is dishonored by nonpayment.In the case of a promissory note if the maker fails to make payment on the due date the note is dishonored by non-payment. A cheque is dishonored by non-payment as soon as a banker refuses to pay. An instrument is also dishonored by non-payment when presentment for payment is excused and the instrument when overdue remains unpaid (Sec 76). 2. 9. Working Definitions ? Negotiable means transferable. The negotiation that goes on refers to the transfer of the instrument between two people, or from one bank to another, or even from one country to ano ther. In the broadest sense, almost any agreed-upon medium of exchange could be considered a negotiable instrument. In day-to-day banking, a negotiable instrument usually refers to checks, drafts, bills of exchange, and some types of promissory notes. ? A Negotiable Instrument is a written order promising to pay a sum of money. ? Banking is the business activity of accepting and safeguarding money owned by other individuals and entities, and then lending out this money in order to earn a profit. 16 Third chapter: Data Collection and Limitation 17 3. 1. Sources of the Data Secondary Sources: For making this study paper, I have collected necessary data from various secondary sources, where data already exists. Because it is cheaper to use and easy to find than having to carry out the research again. Secondary information such as definitions, instruments insights and functions were collected from books of different authors, internet articles and various researches. 3. 2. Limitations of the Data Collection Every study, no matter how well it is conducted has some limitations. When making this assignment, there were also some unavoidable limitations.First, because of the limited time limit, this study was conducted only on a small amount of data. Therefore, this study is little less informative. Also lack of required data. Lack of in-depth knowledge of the topic. Finally, the complexity of the study, as well as the scarcity of related information might decrease the performance of the research. 18 Fourth chapter: Result and Discussion 19 4. 1. Findings In this study I have found a lot of essential knowledge about Negotiable Instruments that are used in banking sectors. Some of them are given below? The instruments should be freely transferable.An instrument cannot be negotiable unless it is such and in such state that the true owner could transfer by simple delivery or endorsement and delivery. ? Negotiability involves two elements namely, transferability free from e quities and transferability by delivery or endorsement. ? The holder of the instrument is presumed to be the owner of the property contained in it. ? ? All Negotiable Instruments are freely transferable. The instrument is transferable till maturity and in case of cheques till it becomes stale (on the expiry of 6 months from the date of issue). Certain equal presumptions are applicable to all negotiable instruments unless the contrary is proved. ? Negotiation of an instrument is a process by which the ownership of the instrument is transferred by one person to another. There are two methods of negotiation: by mere delivery and by endorsement.In its literal sense, the term ââ¬Ëindors ementââ¬â¢ means writing on an instrument but in its technical sense, under the Negotiable Instrument Act, it means the writing of a personââ¬â¢s name on the face or back of a negotiable instrument or on a slip of paper annexed thereto, for the purpose of negotiation. A bill may be dishonored by non-acceptance (since only bills require acceptance) or by non-payment, while a promissory note and cheque may be dishonored by non-payment only. It really depends on the person style, specifications they are looking for, trust in the brand, and the depth of their pockets, how much a person is willing to spend for example on a that high definition led plasma television that is 52 inches. No matter the cost, businesses want to keep a track of the sales of their employees and how much they are getting paid. In this case a high-end electronics store wants to streamline data processing to enable them to help determine the commissions paid to employees. Assignment 2- Database Modeling and Normalization Streamlining processes allows information to be available to users across the system. In order for the finance department to be able to find the commission paid to employeeââ¬â¢s information that maybe held by other departments such as human resources will be needed. Once the database is complete and has all the information such as: employee first and last name, employee ID, yearly salary, commission rate, department, etc, the finance department can then being to generate that information. In this case a query is designed to allow the finance department to determine commissions paid to employees of specific departments. That code will be compared to the code that would show how much total compensation is paid to each employee monthly. Lastly it will be described how Big Data could be used to assist in productivity and forecasting of organizations product and resources. Methods After information is gathered about the employee; most of what was mentioned before, and input into the system a query can be designed to pull that information from the tables. In order to pull information from tables the SELECT function is used to determine the information that is needed and the FROM function tells from what tables to pull it (Coronel, Morris Rob, 2012). The coding that was used to find information on commissions paid to employees was: SELECT Employee. * FROM Employee, Invoice WHERE (DepartmentID =2); The asterisk next to employees indicates that all the information under the employee table was used to generate the search. In this query information was pulled from the employee and invoice tables. The WHERE function more specifically states the department which can be changed and it would generate new information. The query currently only shows employee commission information for employees who work in department two (see attachment). If the finance department wanted to find the total compensation paid to each employee in the same month as the first query a slightly different query would be run to generate that information. The first code simply pulled the information and did not include and computation because the finance department only requested to be able to determine as in pull up the record for employeeââ¬â¢s commission paid. The second code will include computation which will divide the yearly salary by twelve months then multiples the commission rate by the total amount of product sold and lastly add those two numbers together to get the total compensation for that month. Unfortunately the coding that I am using is not generating a proper result. However, it should look something like this: SELECT Employee. EmpNumber, Employee. EmpFirstName, Employee. EmpLastName, Employee. YrlySalary, Invoice. InvAmount, Invoice. InvDate, Employee. CommissionRate FROM Employee INNER JOIN Invoice ON Employee. EmpNumber = Invoice. The Black Cat and The Tell-Tale Heart are two of the earliest horror stories ever written; they were written in the 1840s by the American author Edgar Allan Poe. Poe was born in Boston Massachusetts in 1809. He tragically died in 1849 following a life of alcohol and drugs. The Black Cat tells us about a man who is in a condemned cell. He is on death row and reflecting on his life and the reason behind the situation he is in. He tells the reader about his love for animals and how he married early in life. His wife allowed him to buy a black cat who never left his masters side. However, the narrator tells how he became an alcoholic and started to mistreat his wife and pets. On returning home one night he seized the cat and in fright the cat had bitten him. This made him angry and therefore he cut out one of the cats eyes. A few days later he took the cat, slipped a noose around its neck and hung it from a limb of a tree. That night the house burnt down and engraved on the wall was the figure of a cat. Later on in the story the narrator tells us of how he found a cat that closely resembled the one he had killed. The cat would never leave his side which started to make him hate the creature. He was walking down the steps of the cellar one day with his wife when the cat followed and sent him headlong down the steps. In fury he picked up an axe and aimed a blow at the cat. His wife tried to stop him so he buried the axe into her brain. He buried the body in the wall of the cellar. The police found the body as the man become cocky and tapped on the wall where he had buried his wife, there was a wailing sound and the police uncovered the body with the cat on the corpses head. The Tell-Tale Heart tells us about a man who has been accused of being mad. He looked after an old man who had a vulture eye. His eye was a pale blue and had a film over it. Whenever the eye fell upon the narrator, it made his blood run cold. Therefore he decided to kill the old man. In the week before he killed him the narrator tells us about how he crept into the old mans bedroom every night at midnight, trying to find the right moment to kill him. On the eighth night the old man became aware that someone was in his room. The narrator says how he could hear the mans heart beating in his chest and was frightened that the neighbours would hear it. He ran into the room; seized the man out of his bed and pulled the bed on top of him. He then took the planks from the flooring of the bedroom and placed the body there. Once he had replaced the floorboards the police arrived saying that a neighbour had heard a shriek and they wished to search the property. He led them towards the old mans bedroom and placed some chairs out for them on the exact spot of the body. He began to make typical chat with the officers but could hear the heart of the old man beating louder and louder until it drew the narrator mad and he confessed to the murder. Both stories have typical features of a modern horror story blood, murder, the murders conscience and supernatural aspects. However, the structure of the stories differ. The Black Cat is a longer story and is more detailed. It includes more background description. I was especially fond of animals, and was indulged by my parents with a great variety of pets. This quote shows that The Black Cat tells us about the background of the narrator since he was a young boy. The Tell-Tale Heart is more concise and includes some very detailed sections but less background. Presently, I heart a slight groan, and I knew it was the groan of mortal terror. It was not a groan of pain or of grief Oh no! It was a low stifled sound that arises from the bottom of the soul when overcharged with awe. This quote shows that The Tell-Tale Heart has some very detailed sections as the narrator goes into depth about the noise that the old man made. The two narrators have various things in common; they both tell the story in first person and use eyes as an important feature in the story. In the opening paragraph both narrators also say that they have been accused of madness but deny the accusation. Mad indeed would I be to expect it, In a case where my very senses reject their own evidence. Yet, mad am I not. This quote from The Black Cat supports my point that the narrator has been accused of being mad but denies it. But why WILL you say that I am mad? This quote from The Tell-Tale Heart also supports my point as it is from the opening paragraph of the story and the narrator is asking why he is being accused of being mad. The significant differences between the two narrators are; The Black Cat gives a more in-depth background about his life before the present day whereas The Tell-Tale Heart goes straight into the present. The Black Cat is also set in different rooms of the house and other areas where as The Tell-Tale Heart is set in just one room. The relationship between the readier is also different. The Black Cat is wrote as if the narrator is writing a letter whereas The Tell-Tale Heart is wrote as if the narrator is actually speaking to the reader. For the most wild, yet most homely narrative which I am about to pen. These words suggest to me that The Black Cat tells the story as if he is writing a letter. How then am I mad? This rhetorical question shows that the narrator tells the story as if he is actually talking to the reader. The two narrators in the story get caught as they become too over confident about the hiding place of their victims. They both lead the police to the place that the bodies are buried. Sound is also a major part in the reason for the two narrators getting caught. Poe uses a range of visual and sound techniques to make the stories dramatic and effectible. In both stories sound plays a major part in the narrators getting caught. Then quickly swelling into one long, loud and continuous scream, utterly anomalous and inhuman. This quote from The Black Cat suggests to me that the points I have made are correct. The sound makes the story more dramatic and suspicious. It also leads the police to the corpse. But the beating of the heart grew louder, LOUDER! I thought the heart must burst. This quote also suggests to me that the beating of the heart made the murderer go mad and confess. It also adds an eerie effect to the story. Poe also uses visual description in the stories. The corpse, already greatly decayed and clotted with gore, stood erect before the eyes of the spectators. Upon its head, with red extended mouth and solitary eyes of fire This phrase of writing from The Black Cat goes into great visual detail about the corpse which makes it a lot easier to picture the story in your head. The amount of description sets the scene very effectively and makes the reader feel like there telling the story from their own personal experience. The use of evil words such as greatly decayed and clotted with gore also emphasise the fear and terror of the story. Poe uses a range of imagery in the stories; including alliteration, similes, metaphors, onomatopoeias, and rhetorical questions. These all make the stories dramatic and keep the reader interested. In The Tell-Tale Heart Edgar Allan Poe uses a lot of onomatopoeia and metaphors. my blood ran cold This quote proves the point that Poe uses metaphors in this story. Like the thread of a spider This also proves that Poe uses Similes in this story. Both of these enhance the story as they make it more dramatic and effective. In The Black Cat Edgar Allan Poe uses a lot of alliteration, metaphors and personification. My tenderness of heart This quote is particularly important as later on in the story the narrators heart is the complete opposite from tender. Grew with my growth This quote from the story shows alliteration. By using both of these quotes the writer is making the story more effective as he is making it more interesting to read. He is also encourage interpretation from the reader and helping them to feel the emotion of the characters. Poe also uses language devices to make the stories dramatic and effective. These include rhythm, repetition, and rhetorical questions. In The Tell-Tale Heart. Edgar Allan Poe uses a large amount of rhetorical questions. How then am I mad? This is effective in the story as it involves the reader. It does so by encouraging the reader to reflect upon the question and therefore get involved more with the story. Poe also uses repetition. He had found all in vain. All in vain; because Death, in approaching him. The repetitive phrase all in vain, tells us of the narrators joy at the old mans terror. He also uses a capital D in death. This infers he is using death as a name, suggesting that the old man is death. In The Black Cat Poe uses plenty of rhythm and repetition. Have terrified Have tortured Have destroyed me. In this quote Edgar Allan Poe has repeated the word have. He has used a rhythm by pausing at the end of each word and the dashes indicate an intensity of emotions. He has also used evil words such a terrified and tortured which again emphasise the fear and terror of the story. This makes the story more dramatic. In both stories Poe also uses capital letters to emphasise words this gives an immediate dramatic impact. In conclusion, Poe uses a range of techniques to make his stories dramatic and effective, many of these are still used by horror writers today. Although The Black Cat and The Tell-Tale Heart are similar in numerous ways, Poe uses different techniques in each one to make the stories effective in their own particular way.

Cats Cradle by Kurt Vonnegut Analysis Science is a Good Servant but a Bad Master Science has now known sin. The life of man was very different from what it was a hundred years back. Today, we are all living in a world of modern Science that revolutionized our present day society. We can see how it eventually changed our lives by making everything easier and faster. Science has helped man to lead a better life than ever before through communication, health, security, transportation and entertainment but on the other hand, Science is not just for our own good. It has created deadly and destructive weapons which is mostly used for war. Guns, rifles and grenades are some of those weapons that made man more violent, but the atomic bomb which can potentially wipe out the whole world had caused a lot of suffering and death of innocent people. The quotation above is from the novel Cats Cradle by Kurt Vonnegut that talks about the failure of Science as it was used to create the most destructive weapon on Earth, killing all life forms on Earth. In relation to that, the title itself of the novel is a childrens game that loops strings to create figures and the way it was used in the novel is to explore on how humans shape the world through Science and their own stupidity of misusing it that has led to their own destruction. The novels recurring themes like technological advancements and destruction of humanity illustrates a cross connection and relevance to the real world. It warns that if technological advancement continues without a concurrent growth in ethical awareness, annihilation of the human race is a real possibility. Based from the book Critical Companion to Kurt Vonnegut by Susan Farrell, it criticizes the same idea that Science has already known sin through its technological advancements, since the society had completely cut off from human considerations and I admit that what the author said is true because it is historically proven that the combination of Science with human stupidity will lead to a lot of complications and cause a lot of ecological destructions which put our lives in a great danger. It becomes clear to me that most people are becoming blind to moral basis because they put too much faith in Science and they think that they can understand and control everything through it. How the world works is still not enough to satisfy most human beings, in which greed could be the main source of our own destruction. Science has been a part of everyones lives that provided structure and stability. But some people may consider Science beyond sin, since it only seeks knowledge. As Science continues to be created in a moral vacuum and be used without appropriate consideration of the human consequences, all life on Earth would be in trouble and if it continues to seek in the wrong place and show no signs of correcting itself, it will only lead to the destruction of humanity because knowledge does not always mean progress and that progress is not always beneficial for everything has consequences. Most apocalyptic science fiction novels act as a warning with regards of too much abuse of Science and its technologies. It mostly explores the possible consequences that human may encounter in the future if scientific discovery and research continues in a wrong way. Global events such as the World War II had greatly contributed to the popularity and growth of this form of literature when the possibility of widespread destruction and human extinction caused by nuclear weapons became a large public issue and a dominant threat. While some novels just serve as a mirror to our real world and provide caution about the dangers of nuclear wars, novels like Cats Cradle by Kurt Vonnegut represents a realistic structure of the world we live in. It was created with a personal tone which speaks about the authors personal experiences in World War II. It symbolizes on mans ability to destroy life on Earth with its creation of the real atomic bomb which was used to attack Hiroshima and Nagasaki dur ing the war in August 1945. The novel is an allegory that described on how the world was once destroyed by man through Science by means of nuclear bomb and it is also an authors warning in which this kind of disaster could possibly happen again and result in a terrible future for us. As stated by Fumika Nagano in her criticism from the book Blooms Modern Critical Views: Kurt Vonnegut, Cats Cradle is a novel that talks about the political abuse of Science through its technologies that created an atomic bomb, a weapon for mass destruction specifically in World War II. According to the book, it was reported that it killed a lot of innocent people in Hiroshima and Nagasaki, Japan and people also died from radiation poisoning but some who survived developed some genetic diseases in which they passed on to the next generation such as leukemia. Kurt Vonnegut stated in that book that he completely lost his faith in Science when we dropped scientific truth on Hiroshima. I know for myself that weve been still living in a world with these unending wars but the only way for us to survive is to think independently and reflect on ourselves. We should try to avoid being stupid unthinking sheep that simply do what everyone is doing and accepts whatever the society accepts. We ne ed to set ourselves apart from the rest of the ignorant society. Felix Hoenikker is not a common villainous antagonist in the novel. He is an absent-minded person that lacks interest in his family, especially with his children. He lacks an understanding of basic human emotions. But everyone appreciates his contribution to Science as he was considered the father of the atomic bomb and the creator of the weapon ice-nine, which later leads to the Earths destruction and the end of all lives. Ice-nine is a small substance that Dr. Hoenikker secretly created but eventually falls into the hands of the dominant government in the novel. It is solid at room temperature and has a melting point of 45.8à ¢Ã¢â¬Å¾Ãâ. When this substance comes into contact with liquid water that has a temperature below the melting point of ice-nine like the seas or oceans, it can cause the solidification of the entire body of water and will result to a chain of ecological destruction and end all life on Earth. Dr. Hoenikker is the antagonist of the story due to his perception and views of life. When he was asked about the relation of science and sin, he asks, What is sin? From these instances, he truly shows that he does not care about people or morality and his inability to understand can create destruction and violence around him. Vonnegut wanted us to see Dr. Felix Hoenikker as a representation of the so called saints in the field of Science, which are the scientists who pursue abstract truth and knowledge without considering human consequences. Most of them nowadays is being blinded by power and fame in which they just dont care about others. Some of them works for the government in which they are being manipulated and controlled to build weapons for war. The goal for some scientists is to make their inventions successful and the result of destroying nature and killing innocent people is not their concern. In support to that, according to Walter Shear on his literary criticism entitled Kurt Vonnegut: The Comic Fate of Sensibility, Science exists like a game for scientists in which they play without considering any ethical values and regardless of the destructive outcomes it can have like terrible wars and dehumanization of most individual in the society. I truly agree on his idea about scientists today because in my opinion, scientists consider themselves as masters of nature inspired by scientific advancements and I see them as cold men of Science who are cut off from human concerns. They made Science to commit sin and be manipulated as an evil tool that created the worst human sufferings and might lead to humanitys extinction in the future. The novel is a whole criticism to peoples ignorance. All of the ideas that a society holds about its progress and development including how it is achieved through research and discoveries by the use of Science. However, our worlds greatest or should I say the most destructive scientific discovery is the atomic bomb, which has the capacity of ending thousands of lives. So, a society pursuing a better world through Science is ironic because the further mankind dives into scientific discoveries without ethical understanding, the more destructive the society becomes. Human beings always crave a higher form of truth that will give meaning to their lives. Religions have supplied these higher form of truths in the past but because of Science, through its advancement and its credibility, it became a kind of false religion. This period of history became known as The Enlightenment. It began to free the peoples minds from the teachings of the church for thousands of years. They wanted to change everything and replace faith with knowledge and reason. Today, religions and spiritual truths have become a suspect in the 21st century. But from the criticism of Donald Morse, he brought up the negative outcomes of Science in the 21st century based from some of Kurt Vonneguts novels including Cats Cradle. He emphasized that we are preoccupied with the disastrous effect of weapons like atomic bombs but we havent given any attention on other unforeseen causes of Science that might as well lead to our extinction including pollution and environmental destruction. Modern Science is considered now as a large body of knowledge and nowadays it has a large gap between the stated mission of it to improve and better human life and its actual products, which include weapons of mass destruction. Due to humanitys greediness and being blinded by wealth, people would do anything to have full control of it, as it will eventually be used in wars. Science will lack a moral or unconcerned sense with the rightness or wrongness of something, if it ends up in the hands of an ignorant or greedy person. Human stupidity of misusing it can cause to our own self destruction. The event that happened in Nagasaki and Hiroshima created a new era for us as the world entered the nuclear age. For seven decades since the first atomic bomb was created, it became the scientists ambition to continue pursuing and develop these kind of weapons. Countries like U.S., Russia, United Kingdom, France, China, India, Pakistan and North Korea have admitted that they possess nuclear weapons. The recent atomic bombing event was the North Korean nuclear test that occur five times this year but the current one happened last September 9, 2016 and they did not immediately announce about the test. It is like our humanity is continuously discovering new ideas on how to destroy itself. Science will only be beneficial if it will be used as a common good for mankind and we know that it became our foundation in developing societies and improving human life, however all of us is also worried on the power that Science possesses to destroy life on Earth. It is true that Science can create wonders by all of its discoveries and inventions but the way it is used as a weapon of mass destruction that controls our existence is not its fault. Human stupidity and its unethical values is the main cause why we have these kind of weapons at the first place. Their different ideologies went too far that they had misused Science in creating destructive weapons instead of bettering our world. In the wrong hands, Science will have the capacity to ruin lives of innocent people and if we let it to become our master then it might be the end of the world for us and we will be wipe out from the face of the Earth. We should not let Science overpower us and control our way of life. Science sho uld be use as a support in expanding our knowledge for a great cause, promoting security and safety to everyone, establishing better societies, improving human life and strengthening our moral responsibility. Therefore, it should be our servant in a good way, and not to become our master.

Can I See Your ID? The introduction of young people to beverage alcohol varies considerably in different cultural settings. In many societies, the age at which the purchase and public consumption of beverage alcohol becomes legal is also the age at which other "adult" rights and responsibilities are bestowed. What is neither clear nor consistent is the age at which this should occur. Communities recognize the capacity for alcohol to be abused, particularly by young and inexperienced college students. The imposition of a legal drinking age limit is one aspect of a society's desire to reduce the potential for harms associated with inappropriate drinking patterns. Believe it or not, students who are under 21 do drink. Every weekend, students armed with fake IDs go out to intoxicate their worries away while at the same time attempting to avoid the dreaded Minor In Possession tickets and the Department of Public Safety. Tougher punishments and regulations seem to have little effect on the number o f people who are willing to risk legal ramifications for a drink. The government can help ease the fruitless struggle between students and University officials by lowering the lawful drinking age to 18. At the ripe age of 18, you must enlist to Selective Service. This, meaning that you must tell the government that you are a man now and that you can fight for the country you live in if needed. Seeing how I can go die for my country at the green age of 18; I feel that I should be able to have a drink when I want to. It may seem unfair to many observers to allow 18-20 year olds to marry, to have children, to own cars, homes and firearms and to be financially and socially independent, and yet to be legally prohibited from drinking a glass of wine in a restaurant, or even a glass of champagne at their own wedding. Current laws regarding underage drinking do not make sense. In 1984, Congress enacted the National Minimum Drinking Age Act, which required states to enforce a drinking age of 21 or risk losing some federal highway funds (Engs). The act was originally established to prevent inexperienced drivers from crossing state lines to drink legally and driving back drunk to their home st ates (Engs). However, the genius behind the minimum age act does not apply to the University. Most students do not have cars on campus and those that do are often over 21.

When Japan defeated China in 1895, European powers answered with an order they called, “ carving up the Chinese melon.'; Following the division of Africa among European powers, they turned their sights to what they saw as an extremely weak Chinese government. European powers and America began to scramble for what was called “spheres of interest.'; These spheres of interest involved holding leases for all railway and public advantages in different regions of China. Russia got Port Arthur, Britain got the New Territories near the Hong Kong region, Germany got Shantung and America got nothing. America was focusing largely on Guam and the Philippines and had missed the opportunity and so insisted on the “open-door policy'; in China were commercial opportunities were equally available to all Western powers and the political and territorial integrity of China stayed intact. Ã Ã Ã Ã Ã The imperial court responded to this foreign threat by giving aid to various secret societies. Traditionally, secret societies had been formed in opposition to imperial government; as such, they were certainly a threat to the Ch’ing government. However, anti-foreign sentiment had risen so greatly in China that the Empress Dowager ,ruler of China, believed that the secret societies could be the leaders in a military deportation of Europeans. This policy reached its crucial period in 1900 with the Boxer Rebellion. Ã Ã Ã Ã Ã The Boxers, or “The Righteous and Harmonious Fists,'; were a religious society that had originally rebelled against the imperial government in Shantung in 1898. They practiced an animistic magic of rituals and spells that they believed made them invulnerable to bullets and pain. The Boxers believed that the expulsion of foreign devils would magically renew Chinese society and begin a new golden age. Much of their discontent, however, was focused on the economic scarcity of the 1890’s. They were a passionate and confident group, full of contempt for authority and violent emotions. Ã Ã Ã Ã Ã In reality, the Boxer Rebellion could hardly be classified as either a rebellion or a war against the Europeans. China was largely under control of regional Governors General these regional officials ignored the Empress Dowager’s instructions and put forth every effort to prevent disorder or any harm coming to foreigners. The Boxer Rebellion, then, existed only in a few places and centered in Beijing. The Boxers laid seize to the foreign compound in Beijing cutting the Embassies off from their countries. Based on a system of internal checks and balances will be just in my recommendations to the president of the company, since most of the internal control systems provide for independent internal control; This principle involves the review of data prepared by employees. To get the maximum benefit from an independent internal control : Control values and Integrity from the top make it clear that it is unethical activities will not be accepted, and set the tone for the companyââ¬â¢s culture . There are several principles of management : 1. Establishment of responsibility: management is most effective when a single source may be responsible for the problem, including the authorization and approval of transactions. Weakness: LJB has only one accountant who serves as treasurer and controller , which can optimize the processes , but it creates an inherent risk . Cashier handled informally . Accountant is so busy that the company handles the checkout bit differently . All employees have access to the petty cash drawer and just put a note asking if they use any of the cash. Recommendation: * Align the specific obligations of employees to limit access to authorized employees so that the buyer is not the same person who authorizes the payment without the approval of the head at least . Otherwise , a person may make payments that are made to yourself. * Use unique passwords per employee to protect the purchasing system to provide adequate documents and records management. * Assign petty cash custodian. 2 .
